TERMS OF SERVICE

Online Delivery & Storage

If the Client has opted for online delivery, the files will be delivered via an online downloadable link within 4 business days. The client's files will be stored for 14 days after the date of delivery, and afterwards will be deleted from our storage. It is the Client's responsibility to download their files within this 14 day period to retain their files. Files can also be transferred in-person after the session via a direct file transfer if the client brings their own solid state disk drive of 1TB or more.

Change of Date / Cancellation Policy

The session will begin at the listed date and time, and will continue for the number of hours purchased. The date & time of this session will not be secured and no services will be performed until payment has been fulfilled. For a change of date or session cancellation, the Creative Producer must be notified at hello@sfpodcast.studio at least seven days prior to the scheduled date of event via email for documentation. If an email is sent more than seven days prior to the event, a confirmation of receipt will be sent back by the Creative Producer in writing via email and 50% of the booking cost less tax and processing fees will be refunded back to the Client. Please allow for 5-7 business days for this partial refund process.

If the event is cancelled within seven days of the event date, the client shall pay the full balance of the contract due to the high probability that the Creative Producer will not be able to further book that date. This includes cancellation for any reason including sickness or rescheduling of the Client's podcasting guest. The cost of booking a third-party rental studio is non-refundable, because this cost is paid directly to the studio host and is required to secure your date & time slot.

Failure to Perform

Due to the limited and subjective nature of the event, SF Podcast Studio cannot be held responsible for requested images not taken or missed. SF Podcast Studio is not responsible for the lack of coverage due to scheduling complications due to lateness of individuals. SF Podcast Studio will do their best to fulfill all requests but can make no guarantees all images will be delivered.

Force Majeure

If the SF Podcast Studio or its assigns cannot perform this Agreement in the event that photographic or audio materials are damaged, lost through camera or audio capture malfunction, or otherwise lost or damaged without the fault on the part of SF Podcast Studio, then the SF Podcast Studio shall return any moneys paid by the Client, less the booking fee, taxes, or additional expenses that are expressed in the prior Invoice, and shall have no further liability with respect to the Agreement. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals.

Copyright

All images and audio recordings are copyrighted. The digital images and audio recordings created and captured by SF Podcast Studio remain the property of SF Podcast Studio. Permission is herby granted to the SF Podcast Studio to use any images and audio recordings created and captured under this contract for professional samples, displays, internet website pages, advertising, or any other purpose. If there is any sensitive information present in the audio recordings captured in the session, it is the Client's responsibility to communicate this to the Studio Engineer running the session, and SF Podcast Studio will not use the audio within the corresponding timestamps for any promotional materials.
